SelectaLead.com Terms and Conditions and Credit Card Authorization This agreement will be between you the "Customer" and "SelectaLead.com" or "Parties" will represent the "Customer" and "SelectaLead.com" together. SelectaLead.com is understood to be a legal DBA of SAL Enterprises, LLC, a Delaware Company. The credit card statement will show SAL Enterprises as the receiver of the funds. This agreement will be enforced in accordance to the State Laws of Arizona and is understood to be a legal and binding agreement between both parties. SelectaLead.com has the right to update and revise this agreement at anytime without notice. A "Lead" is defined as an application (containing certain contact information) by a party who has voluntarily expressed interest for a real estate loan, term insurance quote or a debt service quote. Leads are ONLY to be sold to actual mortgage companies, mortgage brokers or banks. There will be a $500 charge PER incident if you do not qualify within these organizations. You will also be charged this amount if purchase leads from SelectaLead and sell them to another party. SelectaLead does not authorize you to sell the data that you purchase. SelectaLead prohibits any lead broker or data broker to purchase leads and will charge the $500 fee immediately upon discovery by SelectaLead.com. SelectaLead Lead Return Policy Leads must be submitted for replacement within 5 business days of purchasing. Leads older than 2 weeks old also cannot be returned. All sales are final and there will be NO refunds for any product and NO cancellations will be permitted. SelectaLead does not guarantee any form of success with the leads. Leads WILL be returned for the following reasons: · Bad phone number · Bad contact name . Applicant is not a home owner . Applicant/Spouse did not fill out form NOTE: SelectaLead Staff may verify your returns to ensure and verify the validity of the reasons why you have returned the lead. This is done due to the unfortunate mishap of customers falsely returning leads that were not bad. Please know that if your lead return ratio exceeds 3-5%, SelectaLead has the right to reject future orders from you or your organization in the future. Additionally, if you attempt to return leads that were purchased more than ONE week old, it may be disregarded. This is due to the level of difficulty it is for our Customer Service Department to verify the input data by the applicant. Leads will NOT be replaced for the following reasons: · Customer has changed their mind · Customer would not return calls/emails…etc · Customer said they had already refinanced or is working with someone else. · Customer input wrong financial, housing or other data that is not related to their contact information. · Any other reason ALL LEADS ARE SUBJECT TO THE VERIFICATION OF THE SELECTALEAD.COM STAFF WHO WILL HAVE THE FINAL SAY IF A LEAD MATCHES THE CRITERIA ABOVE. Each lead can be sold up to 4 times, thus leads posted are NOT Exclusive. SelectaLead.com is NOT responsible if you purchase a lead multiple times and will NOT replace/credit for leads that you do. Please be aware of what leads you purchase and take responsibility. SelectaLead.com is not responsible if the leads were sent but not received by the Customer due to technical limitations by the Customer’s email service. The Customer consents herein to have SelectaLead.com to charge his/her credit card for the agreed amount and agrees that the product they are purchasing only contains the guarantees described herein. There will be a $500 fee if you decide to charge back your credit card for the charges that you voluntarily authorized to be ran, by SelectaLead.com or SAL Enterprises, LLC. The Customer understands that all leads are sold "AS IS" with NO Warranty, all sales are final and that there are NO Refunds, regardless if Customer has no success with the products purchased from "SelectaLead.com.". In the event that there is money left out in a customer's account after 12 months of inactivity, then the customer's account will be terminated and any remaining funds will be forfeited to the company. Both parties agree that there is NO guarantee that the financial, employment, credit and other information provided on the leads are accurate. SelectaLead.com only guarantees one contact number and one contact name will be valid. No other information will be guaranteed for accuracy. Both parties understand that this information is up to the Customer to verify with the applicant. It is also understood that SelectaLead.com is not responsible for any lack of success or response in the leads sold to Customer. There is no guarantee in responsiveness, credit or closing ratio expectations from the leads provided by SelectaLead.com and sold to Customer. The Customer agrees that they will be responsible for all reasonable legal, attorney, and or filing fees that are accrued by SelectaLead.com to recover or defending SelectaLead.com or SAL Enterprises, LLC from any claims by the Customer. This includes but not limited to any legal disputes or if the Customer decides to charge back his/her credit card in which the Customer agrees that they will pay for these accrued legal fees by SelectaLead.com. All disputes will be filed and settled in Maricopa County, Arizona. In the event that the Customer purchases Leads, or any form of data that is more than 60 days old, the Customer agrees to indemnify, defend and hold harmless SelectaLead.com and its officers, directors, employees, owners, representatives, agents, subsidiaries, and affiliates, from and against any and all third party claims, actions, liabilities (including all reasonable costs, expenses, and attorneys fees) arising from or in connection with this agreement or any issues related to the CAN-SPAM Act of 2003. Customer hereby warrants and represents that in obtaining Leads, Customer will fully comply with all Federal and State laws (including the Do Not Call Lists or DNC Lists), including but not limited to the CAN-SPAM Act of 2003.
